1. Acceptance of Terms

By accessing or using ThetaPal (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Description of Service

ThetaPal is a portfolio visualization and analysis tool designed for options traders. The Service connects to your brokerage accounts through SnapTrade, displays your positions, and provides AI-generated analysis and trade recommendations. ThetaPal does not execute trades on your behalf.

3. Not Financial Advice

All AI analysis is generated by third-party machine learning models and may contain errors, inaccuracies, or outdated information. You should not rely solely on ThetaPal's output when making investment decisions. Always consult a qualified financial advisor before making trading decisions. You are solely responsible for your own investment decisions and any resulting gains or losses.

4. User Responsibilities

• You must be at least 18 years old to use the Service
• You are responsible for maintaining the confidentiality of your account credentials
• You are solely responsible for all trading decisions you make, whether or not they are informed by ThetaPal's analysis
• You agree not to use the Service for any unlawful purpose or in violation of any applicable regulations
• You agree not to attempt to reverse engineer, decompile, or otherwise extract the source code of the Service

5. Brokerage Connections

The Service uses SnapTrade to connect to your brokerage accounts. By connecting a brokerage account, you authorize ThetaPal to access and retrieve your account data, including positions, balances, and order history, through SnapTrade's platform. You may revoke this access at any time by disconnecting your brokerage account within ThetaPal or through your SnapTrade settings. ThetaPal is not responsible for any actions taken by SnapTrade or your brokerage.

6. Accuracy of Information

While we strive to display accurate and up-to-date information, we do not guarantee the accuracy, completeness, or timeliness of any data presented through the Service, including market data, position data, or AI-generated analysis. Data may be delayed, incomplete, or contain errors. You should always verify information independently through your brokerage before taking action.

7. Service Availability

The Service is provided on a best-effort basis. We do not guarantee uninterrupted, timely, or error-free operation. We may modify, suspend, or discontinue the Service (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

8. Intellectual Property

The Service and its original content, features, and functionality are owned by ThetaPal and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

9. Limitation of Liability

To the fullest extent permitted by applicable law, ThetaPal and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or financial losses arising from your use of (or inability to use) the Service. This includes, without limitation, any losses resulting from reliance on AI-generated analysis or trade recommendations, inaccurate or delayed market data, unauthorized access to your account, or interruption of Service availability. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless ThetaPal and its operators from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.

12. Termination

We may terminate or suspend your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to the Service or other users. Upon termination, your right to use the Service will immediately cease. You may terminate your account at any time by contacting us at support@thetapal.com.
